I got this link from Top of the Mountain Club member, Joseph OLall, and it's just one more example of what's been allowed to happen by the out-of-control Republicans who've been running our townships and county.

OK....this may be one possible avenue to pursue - Article VI Section 6 -

Officers Liable to Impeachment
Section 6.
The Governor and all other civil officers shall be liable to impeachment for any misbehavior in office, but judgment in such cases shall not extend further than to removal from office and disqualification to hold any office of trust or profit under this Commonwealth. The person accused, whether convicted or acquitted, shall nevertheless be liable to indictment, trial, judgment and punishment according to law.

(REMOVAL FROM OFFICE)

Misbehavior in Office. "Misbehavior in office" as an impeachable offense under the Pennsylvania Constitution, Article VI, Section 6, is equivalent to the common-law crime of misconduct in office variously called misbehavior, misfeasance, or misdemeanor in office. It occurs when there is the breach of a positive statutory duty or the performance by a public official of a discretionary act with an improper or corrupt motive.

From the PA Constitution -
Ineligibility by Criminal Convictions
Section 7.
No person hereafter convicted of embezzlement of public moneys, bribery, perjury or other infamous crime, shall be eligible to the General Assembly, or capable of holding any office of trust or profit in this Commonwealth.

So my fellow concerned Tunk residents, I'm not a lawyer but, it appears as if we all have a valid case under LAW to REMOVE supervisor Van Noy. To hire/promote/appoint a convicted felon to the Monroe County Waste Authority and to also appoint that person to the Tunk Planning Commission is a VIOLATION of our PA Constitution (Article II, Section 7) and remedy can be sought through Article VI, Section 6.

I urge all residents to demand action from the commissioners and the DA's office to resolve this blatant disregard of the BEST interest of the PEOPLE's BUSINESS!!

I got this from a post on thr Pocono Record blog -
"Emergency road for BCW cost the Township $114,000" .

There is an Ethics violation if tunk funds were used to create emergency road for BCW.

Q: What is a conflict of interest under the Ethics Act?
A: Under the Ethics Act, a conflict of interest is the use of the authority of public office/employment or confidential information received by holding such a public position for the private pecuniary benefit of the public official/public employee himself, any member of his immediate family, or a business with which he or a member of his immediate family is associated. 65 Pa.C.S. § 1103(a). The term, "business with which he is associated" is defined as "Any business in which the person or a member of the person's immediate family is a director, officer, owner, employee or has a financial interest. 65 Pa.C.S. § 1102.

Now, since that road benefits no one else but BCW residents, it follows that it should have been done at the cost of BCW residents and not Tunk taxpayers! Remember that BCW is a PRIVATE Development and Tunk twp is under NO OBLIGATION to provide this road.
